Sentencing Reform Task Force | Commission on Criminal and Juvenile Justice

The Sentencing Reform Task Force was seated by the Commission with a start date on September 9, 2020. This Task Force addressed the sentencing topics assigned by the Colorado Commission on Criminal and Juvenile Justice and delineated in the 2020 Biennial Letter and the 2022 Biennial Letter from Gov. Jared Polis pursuant to House Bill 2018-1287. For a summary of the efforts by this Task Force until the May 7, 2023 sunset of the Commission, see Mandates. Upcoming meetings, members, subgroups, previous meeting materials and minutes can be found below.

The Commission previously addressed the topic of sentencing by seating the Comprehensive Sentencing Task Force (Sept. 2010-Sept. 2014) and, prior to that, the Sentencing Task Force (Aug. 2009 to Apr. 2010).

The Working Group created one small Study Group.

Sentence Structure Study Group* - investigated sentencing statutes and cases to assist in drafting statutory provisions.

* Pursuant to § 24-6-402(2)(a), C.R.S., "All meetings of two or more members of any state public body at which any public business is discussed or at which any formal action may be taken are declared to be public meetings open to the public at all times." Study Group members were subject matter experts, only one of whom was a CCJJ member.

Carefully develop and propose recommendations to address, ameliorate, redefine and/or improve...

Customization of supervision level to avoid over-supervision addressing probation practices regarding the use of conditions, length of supervision, and responses to violations and revocations.
Culture, gender, and minority disparities in probation practices and outcomes.
The impact of probation outcomes on the prison population.
The statutory purpose of probation.
Alternatives to probation that can be utilized at the time of sentencing.
Examination of the use of probation as an option for petty offenses.
The topic of traumatic brain injury (TBI) among probationers was deferred, given the creation of the SB 2021-138 Task Force (See mindsourcecolorado.org/sb-138-task-force/) and the Task Force Final Report)
