February 19, 2021 - Q & A Session #1-Misdemeanor Sentencing/Offenses (Virtual)

This optional Question & Answer Session on Misdemeanor Sentencing and Offenses was offered by members of the Sentencing Reform Task Force (SRTF) and its Sentence Structure Working Group to answer questions from Commissioners regarding the preliminary recommendation (see below) presented by the SRTF at the February 12 meeting of the Commission. This meeting was open to the public.

Minutes
There was a single request by a member of the public for a description of the proposed changes to the POWPO* provision in statute. Currently, one with any prior felony conviction who is found in Possession of a Weapon by a Prior Offender results in a Class 5 Felony. The revision applies greater specificity of the Class 5 Felony with applicability to those with a prior VRA offense**, Illegal Discharge of a Firearm, Special Offender (Gun), or F3 Burglary of a Dwelling. Additionally, individuals with any of those prior offenses would no longer be eligible for probation when there is use or threatened use of the weapon. Statutory changes of this and the other proposed sentencing revisions would become effective March 1, 2022.

The SRTF requested reconsideration of a previously approved recommendation (FY21-SR #01) and proposed amendments to and re-approval of this recommendation. The SRTF referenced three handouts:

Parole Working Group Leader, Kristen Hilkey, joined by two members of the Working Group, offered a brief overview of the preliminary Recommendation FY21-SR #02 (Update the Standard Conditions of Parole and revise the Additional Conditions of Parole [Statutory; Policy]), including the updated Standard Conditions of Parole, the Additional Conditions of Parole, and the related Proposed Statutory Language. Three members of the public joined during the meeting period. General orienting questions regarding the recommendation were addressed. Participants were encouraged to review the PowerPoint presentation (see the HANDOUT link immediately below) that includes an overview of the recommendation.

This event, part of the CSG Justice Center’s Course Corrections initiative (csgjusticecenter.org/projects/course-corrections/), will be held in partnership with the Colorado Department of Corrections (CDOC) and the Crime and Justice Institute. Building on CDOC success in reducing returns to prison for people on parole, the new initiative aims to enhance effective parole supervision practices, sustain reduced returns to prison for supervision violations, and increase incentives for rehabilitation among people on parole.

What policies support supervision success;
Data analysis on current supervision trends within CDOC; and
Innovative policy options for enhancing supervision success in Colorado.
