This optional Question & Answer Session on Misdemeanor Sentencing and Offenses was offered by members of the Sentencing Reform Task Force (SRTF) and its Sentence Structure Working Group to answer questions from Commissioners regarding the preliminary recommendation (see below) presented by the SRTF at the February 12 meeting of the Commission. This meeting was open to the public.

There was a single request by a member of the public for a description of the proposed changes to the POWPO* provision in statute. Currently, one with any prior felony conviction who is found in Possession of a Weapon by a Prior Offender results in a Class 5 Felony. The revision applies greater specificity of the Class 5 Felony with applicability to those with a prior VRA offense**, Illegal Discharge of a Firearm, Special Offender (Gun), or F3 Burglary of a Dwelling. Additionally, individuals with any of those prior offenses would no longer be eligible for probation when there is use or threatened use of the weapon. Statutory changes of this and the other proposed sentencing revisions would become effective March 1, 2022.
